Visitation Rights of Minors

by Michelle Kennedy
(Eustis, Florida, Lake County)

My son is 10 years old. He doesn't want to spend Wednesday and every other weekend with his father, as our custody agreement states. I have documentation filed with the police dept written by my son stating his father hit him, yet since no marking or bruising was visible, nothing came of it.

We are currently trying to get a injunction for both children (age 10 and 7)due to their father throwing things at them and threatening them. DCF has been involved once with the case closing last month, yet another case is being opened due to an essay my son wrote at school talking about how he fears his father.

At what age does my son need to be to no longer go to visitation with his father? Is there anything I can do, besides documentation of the emotional and physical abuse my children tell me about? Someone suggested my son keep a journal which he could hand over to the judge, so that his voice could be heard. Will that help? If he is granted a right to choose no more visitations with the father, what happens to my 7yr old daughter?
