Simplified Divorce & Marital Settlement Agreement
by Anonymous from Florida
Simplified Divorce & Marital Settlement Agreement: My husband and I are both seeking to divorce. We have no minor children and we are not seeking any assets from each other. I have printed out the forms. It looks like I should be able to do the simplified dissolution of marriage but I see that there is the Marital Settlement Agreement that has to be filled out.
If there is nothing to be agreed upon there and we are not seeking anything from each other what would we put on this form. Please help.
Answer to Florida Divorce Question
Dear Anonymous,
As crazy as this sounds, the process for the Simplified Dissolution of Marriage can be more complex than the process for a regular petition for Dissolution of Marriage with no Children and No Property,
Form 12.901(b)(3).
It is your choice which process to use.
The simplified process, as you noticed, requires you to complete a Marital Settlement Agreement, while the regular petition does not.
Also, in the simplified process both parties must appear at the final hearing; but in the regular process the respondent may waive notice and appearance, and simply request that the Final Order of Dissolution of Marriage be sent in the mail.
