Revoking Driver License For Child Support

Revoking Driver License For Child Support: Recently, my ex received a notice to suspend his Driver's License from the clerk of courts since he is in arrears by $11,000. The notice to suspend gives him a few options to comply to within 20 days.



In turn, my ex filed a motion to change of venue to move the child support from the county the children & I live in to the county he lives in (about 4-5 hrs driving distance). He states that the travel to & from the court house & expenses incurred is why he wants a change in venue.

My opinion: he wouldn't have to travel to court if he was meeting his child support obligations.

Questions:

1. If he hasn't complied to the options on the notice to suspend, even though he has filed a motion to change venue, will the clerk of courts still proceed with revoking his license?

2. Will a judge approve a change in venue?

Dear K,

My guess about his options on the notice to suspend his license mainly include payment options.

And I also guess that the Department of Revenue will continue to suspend his license until he complies with their request that he pay his support.

We all know, even the Department of Revenue knows, that suspending a driver's license to force payment of child support is not an ideal solution.

If he can't drive, then that could mean he could not get to work.

If he cannot get to work, he cannot pay his child support. Not ideal. But, that is one of the administrative sanctions that is applied to try and force compliance with a child support order.

If he does not comply, then the next level may very well be that he is arrested for contempt of court for non-payment of child support. The clock does not stop ticking, the child support payments continue to accrue while he is incarcerated, although it is understood that he cannot make payments while in jail.

As far as his request for change in venue -- sounds like a long shot to me. Why would a judge allow that for his convenience, when he is not paying his court ordered child support payments?

My guess is that that request for change in venue will be denied. And, if he does not pay a substantial amount for child support his driver's license will be suspended.

My wife's ex is behind almost 60k, and to this day, Florida has done nothing about it, why? I thought he would at least have his license suspended, who is going to help?
