Relocation After Marriage: My fiance may be enlisting into the Army by the time he does I will be his wife. We currently reside in Florida and I have two children from a previous marriage. My ex husband is unstable.



He moves around all the time, can't hold a job, doesn't have a vehicle and is $35k in arrears with child support. My question is will I be able to relocate with my children once my soon to be husband is assigned a duty station?

Dear Jaime,

The process for parental relocation with children is that first you need to ask your ex for his written permission for you to relocate with the children.

If he agrees, this is absolutely the path of least resistance.

There is an entire series of forms on the Florida Supreme Court's website for parental relocation with minor children: 12.950 a, b, c, d, e, f, g, h, i, and j.

These forms are designed for pro se litigants, and are free downloads. Go to www.flcourts.org and click on Family Law Forms in the center of the page under Self-Help.

If he doesn't readily agree to your relocation with the children, you'll have an opportunity at your hearing to convince the judge that the move is in the children's best interests.

Marrying Marine & Will Need to Relocate

I have a custody arrangement for my 7 yr old son. In the agreement I cannot move more than 50 miles away from the non custodial parent.

I plan to marry my fiance and more than likely move because he is currently in the marines and has order to California. What are my chances in Florida to make modifications?

Life goes on after marriage. People fall in love and marry again. There is no bias one way or the other for the courts. As long as your request to relocate is reasonable, and you can work out a reasonable long distance visitation schedule, I don't see why you can't have a modification granted. Of course, every case is different, and if you think there may be some complications in your case, then the best thing you can do is to hire an attorney. --Staff
