Ordered Child Support is Wrong

Ordered Child Support is Wrong: I am married to an individual on child support in Broward County FL from his former girlfriend that he was with for 8 years. The problem is he was there from day one with his daughter till she was 5, he worked she didn't (why wasn't her social security number ran), housing/bills were in his name, he has pictures, birth records and all.



She also used an address she knew he no longer stayed in to receive court dates from the beginning. Now he's obligated to pay child support from the birth of the child! Question is what can we do to prove that he was there?

Answer to Florida Child Support Question

Dear Keikei,

First of all, retroactive child support can only go back for 2 years.

In other words, it can't go back to day one, if you mean they are trying to collect 8 years of child support.

And your husband does not owe child support for the time he was with his ex and daughter and supporting the household.

My suggestion is that he file a Motion to Contest or Dispute Child Support.

He can file that with the clerk of court in Broward County, but he also must copy it to the Florida Department of Revenue. If a judge finds that the child support should not have been awarded, then he can relieve your husband of the obligation to pay it.
