Modifying Child Support & Enforcement Order
by Anonymous from Florida
Modifying Child Support & Enforcement Order:My divorce papers states the ex is supposed to pay 1/2 of kids medical bills and provide a life insurance policy to me for the kids.
He refuses to do so. It's been 2 years and he does not ever pay me back for the medical bills I submit to him.
Also... he makes alot more money and gets a military retirement pension. Can I take him back to court for an increase even if it's only been 2 years since our divorce?
Also, I know his retirement can be calculated as support but what about his disability part from the military as well?

Answer to Florida Court Forms Child Support Question
Dear Anonymous,
You can take your former husband back to court to amend your support order by filing a Supplemental Petition for Modification of Child Support, Supreme Court approved Form 12.905(b), which can be found on the Supreme Court's website at www.flcourts.org.
Have a look at our web-powered instructions page for form 12.905(b).
This form should be used when you are asking the court to change a current court-ordered child support obligation.
The court can change a child support order if the judge finds that there has been a substantial change in the circumstances of the parties and the change is in the child(ren)’s best interests.
Substantial change in circumstances can mean substantial change in the children's needs; your income; or his income.
This Supplemental Petition can be filed at any time there has been a substantial change in circumstances.
Regarding enforcement of your current order for payment of medical bills and providing a life insurance policy you can file a Motion for Civil Contempt Enforcement,
Form 12.960 which is also available on the Supreme Court's website, www.flcourts.org.
