Joint Custody & Child Support Question
by Meagen from Mulberry, Florida, Polk County
Joint Custody & Child Support Question: My fiance has a son with his ex-girlfriend that he strongly dislikes (the girlfriend, that is). He has told her numerous times he doesn't want to be with her so she came up with a plan to file for child support because she doesn't want to go get a job herself.
Then she ran away to Texas with their son three days after he turned one so she wouldn't get in trouble. Soon after moving there she applied for child support there as well as Florida. Is she able to receive child support from both states? What can he do to see his son again?
He's filed for split custody through the FL court system but with her living in another state we're not sure what else to do? As it is now she will not allow him or any of his family to see him as long as he is not with her?
Answer to Florida Child Custody Question
Dear Meagen,
There are a few very important facts that you did not make clear in your question.
How long has your fiance's ex been in Texas?
Paternity must have been established, or else he would not be paying child support.
But, was there a Parenting Plan in place? And, no, she is not allowed to receive child support from both states.
