Florida Divorce With No Common Children:I have been married for 5 years and me and my wife have been separated for 4 years. Now I would like to divorce and my wife wants the same thing.
We don't have any properties together and we don't have actually anything to share.
The problem is that my wife has 2 kids with 2 different fathers. What forms do we need to fill so we can go ahead with a Simplified dissolution of marriage. Thank you.

Dear Ignacio,
You can either file the Petition for Simplified Dissolution of Marriage Form 12.901(a); or Petition for Dissolution with No Minor Child(ren) and No Property Form 12.901(b)(2) -- if neither of the children are common to your marriage.
Have a look at our web-powered instructions page for this form. The Simplified Dissolution Petition in my opinion is more complicated than the regular Petition for Dissolution of Marriage. I know that doesn't seem logical, but it is true.
The Simplified process requires a Marital Settlement Agreement; and other forms which the regular petition does not require. The Simplified process also requires both parties to appear at the court hearing, where the regular process does not.
One other difference is that the Simplified process does not require personal service of process by a Sheriff or private processor, so if you file that way you save that fee, usually between $20-$40, depending on the county.
