Florida Divorce & Illegal Alien: I tried to file for a divorce where we both agree as there are no kids or shared assets. He refused to sign papers because it asked for all kinds of financial info that he did not want to give. He said that I could file for a divorce where I serve him and that he does not answer it and after like 60 days I get divorced. Do you know of such a thing?
Can I do confidentially so not in public records for all to view? He has my name on a bank account and two Bank of American credit cards that I want to be disassociated with and he is refusing.

Dear Elaine,
You can file a Petition for Dissolution of Marriage and have him served with the documents.
He has 20 calendar days to answer.
If he does not answer, then you can go to the clerk of court, and file a Motion for Default.
After that you can request a court hearing and the judge will issue a Default Judgment as your Final Order of Dissolution.
You may be able to include in your Petition a request for relief from his debts.
As an alternative, you may be able to contact the bank and credit card companies and either close the accounts or have your name removed from the accounts.
