Father Wants Son Back: Ex Girlfriend moved off the US Mainland with my son when I opened a DCF case on her. I want my baby back. Not every couple that fathers/mothers a child together should stay together but both are responsible for the well being of the child.
Long story short, I have baby mama drama. She was real reckless and mean to my son because of our bond. He recently made one. She was served with custody papers and I opened a DCF case on her. She left South Florida and took my son to St. Croix US Virgin Islands.
I have a very very strong bond with my son and I want him back. I was down there a few weeks ago for his 1st birthday party. I know where she lives I just don't know her address. The living conditions are not good. They have to use a deep freezer as a fridge and a lamp as the kitchen light. I want my son back in Miami with me where he belongs. Things are so much better up here and she's just a girl that's worried about men and money.
I am not the "legal" father. How do I establish myself as the legal father when I'm up here and she's down there? How do I get her to move back up here? Better yet what are the chances of me getting custody of my son. She's unfit. She even left him in the car while it was still running just to come and argue with me.
When I threatened to call the cops about it she sped off!! Please Help! I just want to be able to see my little man without being hassled. I'm a good father..I've had custody of my first son since he was 14 months old. I am not the perfect person but bottom line is that I LOVE my children.

Dear Hopeful Dad,
Your ex girlfriend may have committed a crime.
Child abduction and kidnapping is a serious crime and in your case this may well have happened.
My suggestion is if you already have a DCF case against her, contact the case manager and find out what they may be able to do for you.
Get immediate legal advice from a Florida attorney.
You should probably begin a Petition for Paternity as well to establish by law your legal rights to your son. Thereafter, it may be very difficult and time consuming to get your son back if the mother refuses to come back to the USA.
