Divorce Spouse in Atlanta Georgia
by Patricia from Tamarac, Florida, Broward County
Divorce Spouse in Atlanta Georgia: I have been separated from my husband for 8 yrs. He had been having a affair with another woman who had followed us from Ft. Lauderdale to Fort Myers, Florida. I want to end this marriage as it literally ended 12 years ago. We are age 65 & I am 70.
He moved a 1 1/2 years ago to Atlanta to care for his elderly father. There isn't any joint property owned & we do not have children. How do I proceed & how much will it cost me. I live on a very limited income & have been dealing with legal aid, and they can't help me.
Answer to Florida Divorce Question
Dear Patricia,
I am so sorry to hear that Legal Aid was unable to help you.
You can file a Petition for Dissolution of Marriage with No Minor Children and No Property and have him served with it.
Once he is served, he will have 20 days to file his Answer.
If he doesn't file an Answer you can still proceed without him, by filing a Motion for Default.
Alternatively, there is a standard form which he can file as his answer where he waives his rights or responsibilities to attend the final hearing.
These forms and other Florida family law forms can be found on the Florida Supreme Court's website at www.flcourts.org. Have a look at our web-powered instructions page for
