Confusing Court Paperwork
by Single Father from Miami, Florida, Miami-Dade County
Confusing Court Paperwork:I am currently a single father that has had custody of my daughter for the past year and a month.
I am really lost in the paper work but I will find a way to figure it out.
In the Form 12.902, if I would like to have child support retroactive for the past year in which she has not paid me, How do I do It?
Do I ask the judge or is there away to file it? Also do you know of any organizations that help fathers to gain full parental responsability for their child?

Answer to Florida Court Forms Child Support Question
Dear Single Father,
The form that you really need is a Motion for Contempt/Enforcement, Supreme Court approved form 12.960. The instructions for that form state, in part:
To initiate a civil contempt/enforcement proceeding against a party who is not complying with a prior court order, you must file a motion with the court explaining what the party has failed to do.
I'm not exactly sure which form 12.902 you are struggling with. There are Financial Affidavits -12.902(b); 12.902(c); 12.902(d); Child Support Guidelines Worksheet - 12.902(e); 12.902(f)(1); 12.902(f)(2); 12.902(f)(3); 12.902(i); and 12.902(j).
I guess that either the Child Support Guidelines Worksheet is giving you trouble; or the Financial Affidavit is the culprit.
You cannot complete the Child Support Guidelines Worksheet until you have both parties' Financial Affidavits. You need to wait until you have the other party's Financial Affidavit to complete the Child Support Guidelines Worksheet.
Until you have both Financial Affidavits, the only thing you can do is fill in your own information.
