Citizenship & Child Support:
In order to receive child support from the other parent of a child do they have to be a U.S. citizen?

What about if they work in the US seasonally?

Dear Anonymous,

Before anyone can receive child support a court needs to make that determination and order child support. Once there is a child support order then it is a matter of enforcement, not citizenship.

Every time someone is hired at a job, there is a "New Hire" worksheet that must be completed by the employer to find out whether the new employee should be making child support payments. If you are not yet to the point where there is a court order for child support that is your first step.

After the court makes the determination and awards child support, then ask child support enforcement and/or the court to impose an Income Deduction Order so that the noncustodial parent's wages can be garnished for support.
