Child Visitation Forms - Do It Yourself

by Robert Hall
(Orange Park, Florida, Clay County)

My daughter is 12 and her mother and i were never married and i never went to court for visitation because we were both in an agreement i can see her anytime. However her husband tells me i have no rights and i can't talk or see my daughter ever again.

I want to fight for visitation and I can't afford a lawyer so i will be doing it myself. What forms do I need in Florida to get visitation?

Answer to Florida Child Visitation Question

Dear Robert,

You will need to establish your paternity of your daughter. The petition that starts this process is the Petition to Determine Paternity and for Related Relief. Download this form and follow all the instructions. You should be able to restore your legal right to visitation with your daughter.

If the other party contests your action, we highly recommend you get an attorney. See our free legal resources page for help in finding free to low cost legal aid. Good luck to you.

We are not lawyers and do not give legal advice.

If you have a court-ordered final judgment that declares a visitation schedule, you should file a Motion for Civil Contempt/Enforcement (Form 12.960).

If you do not have a final judgment with a visitation schedule, you should still file the Petition for Paternity and Other Relief. The "other relief" section is where you will ask for a Parenting Plan and Time Sharing Schedule (custody and/or visitation)
