Child Support Orders in Florida

by Joe from Florida

Child Support Orders in Florida:
My last day of child support is the 31st of August. My son turned 18 in Dec. of 2009 and was to graduate this past May 2010. My son did not graduate and failed.

He has started school this year to retain the few credits that he needs to graduate or 1 semester.

Can custodial mother open up case again to extend to end of semester or full year even though he will be out of school before end of school year?

My son has also worked all summer and and has made his own money. I am at a loss due to the fact that I am struggling to pay for my other family and son. I am about to lose my home due to lack of income. Not paying the required $700 plus per month would be wonderful.

Answer to Florida Court Forms Child Support Question

Dear Joe,

Your son's mother can certainly petition the court to extend your son's child support, if he is age 19 and still enrolled in high school. Whether or not a judge will grant it, is another question.

Before a few years ago, child support ended at age 18. More recently the orders are written so that child support continues until age 19 if the child is attending high school.

As of January 2011, the laws are changing again, and child support will no longer be extended to age 19 if the child is still enrolled in high school.

Be proud of your son for persistence in finishing high school; and working through the summer.

In this economy, young adults are struggling.

For many jobs, they don't stand a chance against older workers with more experience.

Without a high school diploma, it is difficult to land a job at a fast food restaurant.
