Change Injunction Time Share Order
by Concerned Mom from Florida
Change Injunction Time Share Order: I was granted an injunction against my son's father, but the judge awarded him two days and an overnight... all unsupervised. The man is an alcoholic and does drugs, he has also never spent any alone time with my son, nor does he have any of the necessary items (crib, car seat, toys, diapers, etc.) to take care of an 18 month old.
I fear for my son's safety. What forms can I fill out to put into motion an immediate change. I would like to see supervised visits with no overnights, at least until he completes a substance abuse course, anger management course and a parenting course (something I heard a lawyer mention to someone else while I was waiting at the injunction hearing).
Answer to Florida Child Custody Question
Dear Concerned,
In the petition and parenting plan you can explain that there are safety issues with your son's father caring for his son.
The Parenting Course is required for all divorcing couples with children.
I suggest that you point this out to the court in your pleading; and take the course yourself to show the court that you are doing everything right.
Anger management courses are generally required when someone is convicted of, or on probation for domestic violence. The order to attend anger management classes is almost always part of a criminal sentence.
Substance abuse courses are generally required when someone is convicted of, or on probation for a DUI or a drug charge. Again, the requirement to attend substance abuse courses is usually part of a criminal sentence.
However, in your pleading, the
Supplemental Petition for Modification of Parenting Plan, you could certainly request that he court require your son's father to take these courses.
